Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Chisels(the “Service”), a platform for building and running online stores. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Chisels lets you design, publish, and operate a storefront, manage products and orders, and make changes with the help of an AI agent. Features may change over time as the Service evolves.

2. Your account

You must provide an accurate email address and are responsible for activity that occurs under your account. You must be able to form a binding contract and use the Service only in compliance with these Terms and applicable law. Keep your sign-in secure; notify us of any unauthorized use.

3. Your content and your stores

You retain ownership of the content you add to your stores (text, images, product data, and similar). You grant Chisels the limited rights needed to host, process, back up, and display that content to operate the Service on your behalf. You are responsible for your stores, including the products you sell, the claims you make, and compliance with the laws that apply to your business and customers.

4. Acceptable use

You agree not to use the Service to:

  • break the law or infringe others’ rights, including intellectual-property and privacy rights;
  • sell prohibited, unsafe, or fraudulent goods or services;
  • upload malware or attempt to disrupt, probe, or gain unauthorized access to the Service;
  • abuse the AI agent to generate unlawful, harmful, or deceptive material.

5. Payments

Store payments are processed by third-party providers (for example, Stripe) through each store’s own connected account. The store owner is the merchant of record for their sales and is responsible for taxes, refunds, chargebacks, and fulfillment. Chisels is not a party to transactions between a store and its customers. Any fees Chisels charges for the Service will be disclosed to you before they apply.

6. Third-party services

The Service relies on third-party providers for hosting, payments, email, and AI. Your use of the Service may be subject to their terms, and we are not responsible for their acts or omissions.

7. Intellectual property

The Service itself, including its software and branding, is owned by Chisels and its licensors. These Terms grant you no rights in it except the right to use the Service as permitted here.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users. On termination, your right to use the Service ends; some provisions (such as ownership, disclaimers, and limitation of liability) survive.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated output will be accurate or fit for a particular purpose. Review AI-assisted changes before publishing them.

10. Limitation of liability

To the fullest extent permitted by law, Chisels will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability arising out of or relating to the Service will not exceed the amounts you paid us for the Service in the twelve months before the claim.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules.
